Terms of Use

These terms are an agreement between you and Know Before You Own (“KBYO,” “we”) for using the KBYO app and website. By creating an account or using KBYO, you agree to them. Please also read our Privacy Policy.
1. What KBYO is, and isn’t
KBYO is an educational tool that brings together public records and your own observations so you know what to ask before you buy a home. It flags things to look at more closely. It is not a home inspection, appraisal, survey, title search, insurance quote, or legal, financial or real estate advice, and it doesn’t replace licensed professionals. You make your own decisions.
- Public records can be incomplete, out of date or wrong. Always confirm important facts with the original source or a professional.
- A flag is not a diagnosis, and no flag doesn’t mean there’s no problem.
- Distances are straight-line. The nearest school isn’t always the assigned school. School grades are the State of Florida’s.
- KBYO doesn’t rate neighborhoods or their safety; it points you to official sources.
2. The beta
KBYO is in beta. Features may change, pause or stop, and there may be mistakes. The beta is free; we’ll tell you before anything you use starts to cost money.
3. Your account
You must be 18 or older. Give accurate information, keep your password private, and tell us right away if you think someone else has used your account. You’re responsible for activity on your account. You can delete it at any time in the app.
4. Real estate agents
- You confirm you hold an active real estate license in the state you listed, and you’ll keep your details accurate.
- Invite only clients who expect to hear from you, and follow the laws and rules that apply to you, including fair housing laws.
- KBYO is a tool you can share with clients. It isn’t a substitute for your professional duties or for inspections and advice your clients should get.
- We may verify licenses and remove agent features from any account we can’t verify.
5. Walking a property safely and lawfully
Only visit properties you have permission to be on, stay in safe walking areas, and don’t climb, open, or enter anything unsafe. Follow the safety notes in the walkthrough. Respect other people’s privacy when taking photos.
6. Your content
Your answers, notes, photos and files stay yours. You give KBYO permission to store, process and show them as needed to run the app for you and the people you share with. Only upload content you have the right to share, and don’t upload anything unlawful, or other people’s private information without permission.
7. Acceptable use
Don’t misuse KBYO. For example, don’t:
- try to access other people’s accounts or data, or get around security or usage limits;
- copy or collect data from KBYO with automated tools, or resell it;
- use KBYO to discriminate against anyone, or in violation of fair housing or other laws;
- interfere with the app or its providers.
8. Other people’s data and links
KBYO shows information from public agencies and other sources and links to outside websites (like official registries and map directions). We don’t control them and aren’t responsible for their content or availability.
9. KBYO’s app
KBYO, its design, question bank and software belong to us. We give you a personal, non-transferable right to use the app under these terms. If you send feedback or ideas, we may use them without owing you anything.
10. Ending access
You can stop using KBYO and delete your account at any time. We may suspend or close accounts that break these terms or put others at risk.
11. Disclaimers
KBYO is provided “as is” and “as available.” To the fullest extent the law allows, we don’t promise that it will be accurate, complete, uninterrupted or error-free, and we disclaim all implied warranties.
12. Limits on liability
To the fullest extent the law allows, KBYO isn’t liable for indirect or consequential losses, or for decisions you make about a home, and our total liability for any claim about the app is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
13. Florida law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Florida, unless the law requires otherwise.
14. Changes
We may update these terms. If a change is meaningful, we’ll tell you in the app or by email before it takes effect, and ask you to agree again where required.
